There is another twist in the case against Neri-Sottoli getting a Pro Continental licence. This tie, the prpblem are riders who race for the team, but are not from Italy. They have believed to be using illegal licenses. One such rider is Rafael Andriato.
The federal prosecutor Giovanni Grauso has appealed to the Federal Court of Appeal with respect to the decision of the Disciplinary Committee.
"On December 15 were filed the written judgment”- Attorney Grauso explained to Tuttiobici- “in which the Commission declared itself "not competent" to rule on this case, entering the field of labor law, as regards to contracts for foreign athletes who perform their activities in Italy and an Italian team. The Attorney legislation granted seven days to analyze motivations and present a possible appeal: we have carefully evaluated and considered appropriate that the Commission of Federal Appeals. All parties are now informed by registered and therefore I believe that within a month, we can put an appeal before the Committee.”
Should the appeal be successful, the team may lose their newly regained Pro Continental license.
